Kwiczy Terms & Conditions

Introduction
Welcome to Kwiczy, South Africa's trusted service marketplace connecting Clients with local Fixers (plumbers, electricians and other skilled professionals). These Terms & Conditions ("Terms", "Agreement") govern your access to and use of the Kwiczy platform, website, mobile application, and services (collectively, the "Platform").
By accessing or using Kwiczy, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.
Important: These Terms constitute a legally binding agreement between you and Kwiczy. Please read them carefully before using our services.
Definitions
For the purposes of these Terms:
- "Kwiczy", "we", "us", or "our" refers to Kwiczy (Pty) Ltd and its affiliates.
- "Platform" refers to the Kwiczy website, mobile application, and all related services.
- "Client" or "you" refers to any individual or entity using Kwiczy to book and pay for services.
- "Fixer" refers to any service provider (plumber, electrician, handyman, locksmith, etc.) offering services through the Platform.
- "User" refers to any person using the Platform, whether as a Client, Fixer, or both.
- "Service" refers to any work performed by a Fixer for a Client through the Platform.
- "Booking" refers to a service request made by a Client through the Platform.
- "Job" refers to a confirmed booking where a Fixer has accepted a Client's service request.
Acceptance of Terms
By creating an account, accessing, or using the Kwiczy Platform, you acknowledge that:
- You have read, understood, and agree to be bound by these Terms.
- You are at least 18 years of age and have the legal capacity to enter into this Agreement.
- You will comply with all applicable laws and regulations in South Africa.
- You will provide accurate, current, and complete information when using the Platform.
- You are responsible for maintaining the confidentiality of your account credentials.
If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
Account Registration and Security
Account Creation
To use Kwiczy, you must create an account by providing:
- Your full name
- Valid email address
- Phone number
- Password (which you must keep secure)
You may also be required to provide additional information depending on whether you register as a Client, Fixer, or both.
Account Security
You are solely responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying Kwiczy immediately of any unauthorized use of your account
- Ensuring your account information remains accurate and up to date
Kwiczy is not liable for any loss or damage arising from your failure to maintain account security.
Account Suspension or Termination
Kwiczy reserves the right to suspend or terminate your account at any time, with or without notice, if:
- You violate these Terms or any applicable laws
- You engage in fraudulent, abusive, or illegal activity
- You provide false, misleading, or incomplete information
- You fail to pay any fees or charges when due
- Your conduct is harmful to other users or Kwiczy's reputation
General Terms (Applicable to All Users)
Platform Availability
Kwiczy strives to provide continuous access to the Platform but does not guarantee:
- Uninterrupted or error-free service
- That the Platform will be available at all times
- That all features will function without interruption
- Compatibility with all devices or browsers
Kwiczy may temporarily suspend access for maintenance, updates, or technical issues without prior notice.
User Conduct
All users must:
- Use the Platform in a lawful and respectful manner
- Treat other users with respect and professionalism
- Provide accurate and truthful information
- Comply with all applicable laws and regulations
- Respect intellectual property rights
- Not interfere with or disrupt the Platform's operation
Prohibited Activities
The following activities are strictly prohibited on the Kwiczy Platform:
- Fraudulent Activity: Any form of fraud, deception, or misrepresentation
- Illegal Services: Requesting or offering illegal services or activities
- Harassment: Harassing, threatening, or abusing other users
- Spam: Sending unsolicited messages or communications
- Circumvention: Attempting to bypass Platform fees or conduct transactions outside the Platform
- Unauthorized Access: Attempting to gain unauthorized access to accounts, systems, or data
- False Information: Providing false, misleading, or incomplete information
- Impersonation: Impersonating another person, entity, or Kwiczy representative
- Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble the Platform
- Data Mining: Scraping, harvesting, or collecting data from the Platform without authorization
- Interference: Interfering with or disrupting the Platform's security, servers, or networks
Violation of these prohibitions may result in immediate account suspension or termination and potential legal action.
Intellectual Property
All content on the Kwiczy Platform, including but not limited to:
- Logos, trademarks, and brand names
- Website design and layout
- Software code and applications
- Text, graphics, images, and videos
- User interface elements
is the exclusive property of Kwiczy or its licensors and is protected by South African and international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, or distribute any Platform content without written permission
- Use Kwiczy's trademarks or logos without authorization
- Create derivative works based on the Platform
- Remove or alter any copyright, trademark, or proprietary notices
User-Generated Content
By posting, uploading, or submitting content to the Platform (reviews, photos, messages, etc.), you grant Kwiczy a worldwide, non-exclusive, royalty-free license to:
- Use, reproduce, and display your content on the Platform
- Modify and adapt your content for Platform purposes
- Use your content for marketing and promotional purposes (with your consent where required by law)
You represent that you own or have the right to grant this license and that your content does not violate any third-party rights or applicable laws.
Privacy and Data Protection
Your privacy is important to us. Kwiczy's collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms.
By using the Platform, you consent to:
- The collection and processing of your personal data as described in our Privacy Policy
- The use of cookies and similar technologies
- Data sharing with Fixers (for Clients) and Clients (for Fixers) as necessary for service delivery
- Compliance with the Protection of Personal Information Act (POPIA) and other applicable data protection laws

Fees and Payment Processing
Kwiczy charges the following fees:
- Booking Fee: R40 (charged to Clients upon booking)
- Service Fee: R60 (charged to Fixers per job accepted)
- Total Platform Fee: R100 per completed transaction (R40 booking fee + R60 service fee)
These fees are separate from the service charges agreed upon between Clients and Fixers.
Pricing Transparency
The prices displayed to Clients are the exact rates set by Fixers. All money and fees are processed privately between Clients and Fixers. Kwiczy only collects the booking fee (from Clients) and service fee (from Fixers).
All payments are processed securely through Paystack. By using the Platform, you agree to Paystack's Terms of Service and Privacy Policy.
Kwiczy reserves the right to modify fees with reasonable notice. Fee changes will not affect bookings already confirmed at the time of the change.
Client Terms
1. Account Registration for Clients
To book services through Kwiczy, you must:
- Create a Client account with accurate information
- Provide a valid email address and phone number
- Verify your email address (if required)
- Be at least 18 years of age
You may be required to provide additional information, such as:
- Billing address
- Payment method details
- Service location details
2. Booking Services
How to Book
- Browse available Fixers on the Platform
- Select a specific Fixer from the available list
- Review Fixer profile, ratings, and reviews
- Choose booking type:
- Instant Booking (ASAP): Immediate service booking
- Quote Request: Request a quote consultation
- Provide booking details (service description, job address, etc.)
- Make payment through the Platform
- Wait for Fixer to accept your booking
Booking Requirements
When booking a service, you must provide:
- Accurate description of the work required
- Correct service location and access instructions
- Preferred date and time (if applicable)
- Any special requirements or constraints
- Accurate contact information
Booking Confirmation
A booking is confirmed when:
- You have submitted a booking request
- Payment has been successfully processed
- The Fixer has accepted your booking (status changes from 'open' to 'in_progress')
Once confirmed, you will receive a booking confirmation via email and in-app notification.
Note: For both instant bookings and quote requests, the Fixer must accept the booking before the service begins.
3. Payment Obligations
Payment Methods
Kwiczy accepts payments through:
- Credit cards
- Debit cards
- Bank transfers (via Paystack)
- Other payment methods as may be available
Payment Processing
- Payments are processed securely through Paystack
- Booking fees (R40) are charged immediately when you make a booking
- The booking fee must be paid successfully before your booking is confirmed
- If payment fails, your booking will not be created
- All labor and material costs are arranged directly between you and the Fixer
- You authorize Kwiczy to charge your payment method for:
- Booking fees (R40 booking fee for all bookings)
Payment Authorization
By providing payment information, you authorize:
- Kwiczy to charge your payment method for all fees and charges
- Automatic payment processing for confirmed bookings
- Payment of any additional charges you approve during or after service delivery
Failed Payments
If a payment fails:
- Your booking may be cancelled
- You may be charged a failed payment fee (if applicable)
- You must update your payment method to proceed
4. Service Delivery
Fixer Responsibilities
Fixers are responsible for:
- Arriving at the scheduled time and location
- Performing services as described and agreed
- Providing professional, quality work
- Complying with all applicable laws and regulations
- Maintaining appropriate insurance and licenses
Your Responsibilities as a Client
You are responsible for:
- Providing accurate booking information
- Being available at the scheduled time (or arranging access)
- Providing a safe working environment
- Paying for services as agreed
- Communicating clearly with the Fixer
Service Completion
A service is considered complete when:
- The Fixer has completed the agreed work
- You have confirmed completion (or the completion period has elapsed)
- Any required documentation or receipts have been provided
Upon completion, you pay the Fixer directly for labor and materials as agreed. Kwiczy does not handle labor payments - all service charges are arranged privately between you and the Fixer.
5. Cancellation Rules for Clients
Cancellation Before Fixer Acceptance
If you cancel a booking before the Fixer has accepted, you are eligible for a full refund as outlined in our Refund Policy.
Cancellation After Fixer Acceptance
If you cancel a booking after the Fixer has accepted:
- Standard cancellation terms apply
- Refunds may not be available (see Refund Policy)
- Cancellation fees may apply if the Fixer has already:
- Traveled to your location
- Purchased materials
- Allocated time that cannot be rebooked
How to Cancel
To cancel a booking:
- Log into your Kwiczy account
- Navigate to "My Bookings"
- Select the booking you wish to cancel
- Click "Cancel Booking" and follow the prompts
- Contact support if you need assistance
Note: Cancellation terms may vary depending on the service type and timing. Please review the specific cancellation policy for your booking.
6. Refunds
Refund eligibility and processing are governed by our Refund Policy, which forms part of these Terms.
Key points:
- Refunds are available in specific circumstances (see Refund Policy)
- Refunds are processed via Paystack to your original payment method
- Processing time: 5-14 business days for approval, 7-10 business days for processing
- Platform fees (R40 booking fee) may be non-refundable in certain circumstances

7. Reviews and Ratings
After service completion, you may:
- Rate the Fixer (1-5 stars)
- Write a review describing your experience
- Provide feedback to help other Clients
Reviews must be:
- Truthful and based on actual experience
- Respectful and professional
- Free from defamatory, offensive, or inappropriate content
- Compliant with applicable laws
Kwiczy reserves the right to remove reviews that violate these Terms or applicable laws.
8. Client Conduct and Prohibited Activities
As a Client, you must not:
- Request Illegal Services: Request services that are illegal or violate applicable laws
- Harass Fixers: Harass, threaten, or abuse Fixers
- Circumvent Fees: Attempt to book services outside the Platform to avoid fees
- Provide False Information: Provide false or misleading booking information
- Refuse Payment: Refuse to pay for completed services without valid reason
- Damage Property: Damage Fixer property or equipment
- Interfere with Work: Interfere with or obstruct Fixer's ability to perform services
- Request Unreasonable Work: Request work that is unsafe, unethical, or beyond the Fixer's capabilities
Violation of these rules may result in account suspension or termination.
9. Disputes with Fixers
If you have a dispute with a Fixer:
- Contact the Fixer First: Attempt to resolve the issue directly
- Contact Kwiczy Support: If direct resolution fails, contact our support team
- Provide Evidence: Submit relevant documentation, photos, or communication
- Allow Review Time: Allow 5-14 business days for Kwiczy to review your case
Kwiczy will:
- Review disputes fairly and objectively
- Contact both parties for clarification
- Make a decision based on available evidence
- Facilitate refunds or other resolutions where appropriate
Kwiczy's decision in disputes is final, subject to your rights under applicable law.
Fixer Terms
1. Account Registration and Verification for Fixers
Registration Requirements
To become a Fixer on Kwiczy, you must:
- Create a Fixer account with accurate information
- Provide professional credentials and qualifications
- Complete the vetting process (background checks, verification)
- Provide proof of:
- Identity (South African ID or valid work permit)
- Professional qualifications or licenses (where applicable)
- Business registration (if operating as a business)
- Insurance coverage (where required for your service type)
Vetting Process
Kwiczy conducts a vetting process that may include:
- Identity verification
- Background checks
- Qualification verification
- Reference checks
- Interview or assessment (if required)
You must provide accurate information and cooperate fully with the vetting process. Providing false information may result in immediate account termination.
Account Approval
Your Fixer account will be activated only after:
- Successful completion of the vetting process
- Approval by Kwiczy
- Acceptance of these Terms and all applicable policies
Kwiczy reserves the right to reject applications at its sole discretion.
2. Availability Management
Setting Availability
As a Fixer, you are responsible for:
- Accurately setting your availability on the Platform
- Updating availability in real-time
- Ensuring availability reflects your actual capacity
- Responding promptly to booking requests
Availability Status
You can set your availability status as:
- Available: Ready to accept new bookings
- Unavailable: Not accepting new bookings
Important: If you mark yourself as available, you are expected to respond to booking requests promptly and accept bookings you are capable of completing.
Automatic Availability Management
Kwiczy may automatically adjust your availability based on:
- Your response rate
- Your acceptance rate
- Your completion rate
- Time of day (e.g., after 6 PM SAST, you may be marked as unavailable)
You can override automatic settings, but doing so may affect your visibility and ranking on the Platform.
3. Accepting Jobs
Job Acceptance
When you receive a booking request:
- You have a specified time period to accept or decline
- Accepting a booking changes the status from 'open' to 'in_progress' and creates a binding agreement to perform the service
- You must be capable of completing the work as described
- You must be available at the scheduled time and location
- Upon acceptance, you will be automatically marked as unavailable to prevent double bookings
Quote Requests
For quote requests (bookings for quote services):
- Clients book a quote service through the Platform
- You can accept or decline quote request bookings like any other booking
- Once accepted, you are expected to provide the quote service as booked
- The quote service is a consultation to assess the work and provide pricing information
Declining Jobs
You may decline bookings if:
- You are unavailable at the scheduled time
- The work is outside your expertise or capabilities
- The location is outside your service area
- You have legitimate reasons that prevent you from completing the work
Note: Excessive declining may affect your visibility and ranking on the Platform.
4. Service Delivery
Your Responsibilities
As a Fixer, you are responsible for:
- Arriving on Time: Arriving at the scheduled time and location
- Professional Conduct: Maintaining professional behavior and appearance
- Quality Work: Performing services to a professional standard
- Safety: Ensuring your work is safe and complies with applicable regulations
- Communication: Communicating clearly with Clients about work progress and any issues
- Documentation: Providing receipts, invoices, or other documentation as required
- Cleanup: Cleaning up work areas after completing services
Service Standards
Services must be performed:
- In accordance with industry standards and best practices
- In compliance with all applicable laws and regulations
- As described in the booking and agreed with the Client
- Using appropriate tools, materials, and techniques
Materials and Supplies
- You are responsible for providing necessary tools and equipment
- All materials and supplies are handled privately between you and the Client
- Kwiczy is not involved in material procurement, payment, or reimbursement
- Any agreements regarding materials (who provides them, costs, reimbursement, etc.) are made directly between you and the Client
Completion and Payment
- Mark jobs as complete when work is finished
- Request Client confirmation (if required)
- All labor and material costs are arranged directly between you and the client
- Kwiczy only collects the R60 service fee for matching you with clients
5. Payment and Service Fee Terms
Service Fees
Kwiczy charges a R60 service fee per job accepted. This fee is paid when you accept a job, not when it's completed. All labor and material costs are arranged directly between you and the client - you keep 100% of your quoted rates.
Payment from Clients
Important: All labor and material costs are arranged directly between you and the client. Kwiczy does not handle or process payments for your services.
- You set your own hourly rates and call-out fees
- You negotiate payment terms directly with clients
- You keep 100% of your quoted rates (Kwiczy only collects the R60 service fee)
- Payment methods and timing are agreed upon between you and the client
- You are responsible for collecting payment from clients
Taxes and Reporting
- You are responsible for:
- Declaring all earnings for tax purposes
- Paying applicable taxes (income tax, VAT if registered)
- Maintaining records of all transactions with clients
- Issuing invoices or receipts to clients as required
- Kwiczy only provides documentation for the R60 service fees collected
- Consult a tax professional for advice on your specific situation
Payment Disputes with Clients
If there is a payment dispute between you and a client:
- Kwiczy is not involved in labor payment disputes
- You should resolve payment issues directly with the client
- Kwiczy support can assist with platform-related issues only
- For serious disputes, you may need to seek legal advice
6. Cancellation Rules for Fixers
Rejecting Bookings Before Acceptance
You can reject or decline bookings before accepting them (while status is 'open'):
- Navigate to "My Jobs" in your dashboard
- Select the booking you wish to reject
- Click "Reject" to decline the booking
- The Client will be notified and eligible for a full refund (see Refund Policy)
- Your rejection rate may be tracked
- Excessive rejections may affect your visibility and ranking on the Platform
Cancellation After Acceptance
Important: Once you have accepted a booking (status changes to 'in_progress'), you cannot cancel the booking through the Platform.
If exceptional circumstances arise after acceptance that prevent you from completing the work:
- Contact the Client immediately to discuss the situation
- Contact Kwiczy support for assistance
- Each case will be reviewed individually
- Resolution will depend on the specific circumstances and may involve:
- Arranging alternative solutions
- Partial payment arrangements based on work completed
- Refunds processed as appropriate
Note: Accepting a booking creates a binding agreement to perform the service. Failure to complete accepted bookings may result in account suspension or termination.
7. Reviews and Ratings
Client Reviews
Clients may rate and review your services after completion. You:
- Cannot prevent Clients from leaving reviews
- Should respond professionally to reviews (positive or negative)
- Can report reviews that are false, defamatory, or violate Terms
- Should focus on providing excellent service to earn positive reviews
Your Response
You may respond to reviews, but responses must be:
- Professional and respectful
- Truthful and accurate
- Free from defamatory or offensive content
- Compliant with applicable laws
Review Removal
Kwiczy may remove reviews that:
- Violate these Terms
- Contain false or defamatory information
- Are posted by users who did not use your services
- Violate applicable laws
8. Fixer Conduct and Prohibited Activities
As a Fixer, you must not:
- Provide Illegal Services: Offer or perform illegal services
- Harass Clients: Harass, threaten, or abuse Clients
- Circumvent Fees: Attempt to conduct transactions outside the Platform to avoid fees
- Provide False Information: Provide false qualifications, experience, or credentials
- No-Show: Fail to arrive at scheduled appointments without valid reason
- Substandard Work: Perform work that does not meet professional standards
- Overcharge: Charge amounts significantly higher than agreed without Client agreement
- Unprofessional Conduct: Engage in unprofessional, unsafe, or unethical behavior
- Solicit Clients: Solicit Clients to book services outside the Platform
- Multiple Accounts: Create multiple accounts to avoid restrictions or fees
Violation of these rules may result in:
- Account suspension or termination
- Withholding of payments
- Legal action where appropriate
9. Insurance and Liability
Insurance Requirements
Depending on your service type, you may be required to maintain:
- Public Liability Insurance: Coverage for damage to Client property or injury to Clients
- Professional Indemnity Insurance: Coverage for errors or omissions in your work
- Workers' Compensation: If you employ staff
You must provide proof of insurance if requested by Kwiczy.
Your Liability
You are responsible for:
- Any damage to Client property caused by your work or negligence
- Any injury to Clients or third parties resulting from your work
- Compliance with all applicable laws, regulations, and building codes
- Obtaining necessary permits or licenses for your work
Kwiczy is not liable for:
- Damage or injury caused by your work
- Disputes between you and Clients
- Your failure to maintain appropriate insurance
- Your violation of applicable laws or regulations
Indemnification
You agree to indemnify and hold Kwiczy harmless from any claims, damages, or expenses arising from:
- Your provision of services
- Your violation of these Terms
- Your violation of applicable laws
- Your negligence or misconduct
10. Disputes with Clients
If you have a dispute with a Client:
- Contact the Client First: Attempt to resolve the issue directly
- Contact Kwiczy Support: If direct resolution fails, contact our support team
- Provide Evidence: Submit relevant documentation, photos, or communication
- Allow Review Time: Allow 5-14 business days for Kwiczy to review your case
Kwiczy will:

Privacy & Data Protection
Collection of Information
Kwiczy collects and processes personal information as described in our Privacy Policy, which forms part of these Terms.
Use of Information
Your information is used to:
- Provide and improve Platform services
- Process payments and transactions
- Verify identities and conduct vetting
- Communicate with you about bookings and services
- Send marketing communications (with your consent)
- Comply with legal obligations
Data Sharing
Kwiczy may share your information with:
- Clients (for Fixers): Your profile, ratings, and contact information
- Fixers (for Clients): Your booking details and contact information
- Service Providers: Payment processors, cloud services, etc.
- Legal Authorities: When required by law or to protect rights
Data Security
Kwiczy implements reasonable security measures to protect your information, but cannot guarantee absolute security.
Your Rights
Under POPIA and applicable laws, you have the right to:
- Access your personal information
- Correct inaccurate information
- Request deletion of your information (subject to legal requirements)
- Object to processing of your information
- File a complaint with the Information Regulator

Intellectual Property
Kwiczy's Intellectual Property
All Platform content, including:
- Logos, trademarks, and brand names
- Website design and software
- Text, graphics, and images
- User interface elements
is owned by Kwiczy or its licensors and protected by intellectual property laws.
Your Intellectual Property
You retain ownership of content you create and post on the Platform, but grant Kwiczy a license to use it as described in "User-Generated Content" above.
Trademark Usage
You may not use Kwiczy's trademarks, logos, or brand names without written permission.
Liability & Disclaimers
Platform Disclaimer
Kwiczy provides the Platform "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:
- Warranties of merchantability
- Warranties of fitness for a particular purpose
- Warranties of non-infringement
- Warranties that the Platform will be uninterrupted or error-free
Service Disclaimer
Kwiczy is a marketplace platform connecting Clients and Fixers. Kwiczy:
- Does not provide the services itself
- Does not guarantee the quality, safety, or legality of services
- Does not guarantee Fixer qualifications or credentials
- Is not responsible for disputes between Clients and Fixers
- Does not endorse or recommend specific Fixers
Limitation of Liability
To the maximum extent permitted by law, Kwiczy's liability is limited as follows:
- Total Liability: Kwiczy's total liability for any claims shall not exceed the amount you paid to Kwiczy in the 12 months preceding the claim
- Indirect Damages: Kwiczy is not liable for indirect, incidental, consequential, or punitive damages
- Service Issues: Kwiczy is not liable for issues arising from Fixer services, including:
- Property damage
- Personal injury
- Financial loss
- Service quality issues
Exceptions
Nothing in these Terms excludes or limits Kwiczy's liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by law
Your Responsibility
You are responsible for:
- Verifying Fixer qualifications and credentials
- Ensuring services meet your requirements
- Maintaining appropriate insurance
- Complying with all applicable laws
Dispute Resolution
Internal Dispute Resolution
Before initiating formal proceedings, you agree to:
- Contact Support: Attempt to resolve disputes through Kwiczy support
- Good Faith Negotiation: Engage in good faith negotiations for at least 30 days
- Mediation: Participate in mediation if requested by Kwiczy
Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.
Jurisdiction
Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.
Class Action Waiver
You agree that any disputes will be resolved individually, and you waive the right to participate in class actions or representative proceedings.
Changes to Terms & Conditions
Right to Modify
Kwiczy reserves the right to modify these Terms at any time. Changes will be:
- Posted on this page with an updated "Last Updated" date
- Communicated to users via email for significant changes
- Effective immediately upon posting (unless otherwise stated)
Your Acceptance
Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Platform and may terminate your account.
Review Period
For significant changes, Kwiczy may provide a review period during which you can accept or reject the changes. If you reject significant changes, your account may be terminated.

Termination by You
You may terminate your account at any time by:
- Contacting Kwiczy support
- Using the account deletion feature (if available)
- Closing your account through your account settings
Termination by Kwiczy
Kwiczy may terminate or suspend your account:
- Immediately for violations of these Terms
- With notice for other reasons (as determined by Kwiczy)
- For inactivity (extended periods of non-use)
Effect of Termination
Upon termination:
- Your access to the Platform will be revoked
- Your account and data may be deleted (subject to legal requirements)
- Outstanding payments will be processed according to these Terms
- You remain liable for any obligations incurred before termination
Force Majeure
Kwiczy is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Pandemics or health emergencies
- Government actions or restrictions
- War, terrorism, or civil unrest
- Internet or telecommunications failures
- Strikes or labor disputes
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
Entire Agreement
These Terms, together with the Refund Policy and Privacy Policy, constitute the entire agreement between you and Kwiczy regarding your use of the Platform and supersede all prior agreements and understandings.

- You have completed the vetting process truthfully
- You will provide professional, quality services
- You understand payment and payout terms
- You will maintain appropriate insurance and licenses
- You are an independent contractor, not an employee of Kwiczy
- You are responsible for your own taxes and legal compliance
- Kwiczy is not liable for disputes with Clients or service-related issues
